This policy explains what personal information EmeyInCostaRica.com collects, why, who it is shared with, and the choices and rights you have. It is written for visitors from everywhere, with specific sections for Costa Rica, Canada and California.

Who I am

EmeyInCostaRica.com is run by Emey Kolb, a real estate agent with Expat Properties | CR, based in Playas del Coco, Guanacaste, Costa Rica. I am the person responsible for the personal information collected on this site (the "controller" or "responsable de la base de datos").

What I collect

I do not ask for sensitive information, and I do not knowingly collect information from children under 16. The site is meant for adults planning a move or a purchase.

How I use it

• To send you the Starter Guide you asked for.
• If you ticked the box: to email you new listings and journal posts. Every email includes a working unsubscribe link.
• To reply to your questions and help with your search for a home.
• To keep the site secure, prevent spam and fix problems.

I do not sell your personal information, I do not "share" it for cross-context behavioral advertising, and I do not use it for automated decisions about you.

Who receives it

Only the service providers needed to run the site and send email, under contracts that limit their use of your data:

• Cloudflare, Inc. (United States): website hosting, security and delivery.
• My email service provider: stores the subscriber list and sends the guide and updates. Its name will be listed here once connected.
• Expat Properties | CR: the brokerage I work with, only if you ask me to help you buy, sell or rent and your details are needed for that.
• Photos from expatpropertiescr.com and expatharmony.com: some photos load from those websites, which receives standard technical data (such as your IP address) when your browser loads them.
• Sea Breeze page: the Sea Breeze page shows an interactive tool loaded from seabreezecr.com, operated by a third party. When you open that page, that provider receives standard technical data from your browser and may use cookies under its own privacy policy.

Some of these providers store data outside Costa Rica and outside Canada, mainly in the United States. By using the forms you agree to that transfer. Your information may be disclosed if the law requires it.

Cookies and tracking

This site itself sets no advertising or tracking cookies and does not run ad pixels. Cloudflare may set strictly necessary security cookies to protect the site from abuse. If I add privacy-friendly visit statistics, I will use a cookieless tool and update this policy.

Do Not Track: because this site does not track you across other websites, it does not change its behavior when your browser sends a Do Not Track or Global Privacy Control signal. Third parties do not collect information about your activity across sites through this site, except as described for the Sea Breeze page above.

Email consent

The updates box on every form starts unticked. I only send listing and journal emails if you tick it. Each email identifies me, gives my contact details and includes an unsubscribe link that works for at least 60 days; unsubscribe requests are processed within 10 business days, usually much sooner. You can also simply reply or message me to stop.

How long I keep it

I keep your name and email while you are subscribed, or for up to 24 months after our last contact if you only downloaded the guide, then delete it. When you unsubscribe I keep only your email on a suppression list so I never email you again. Technical logs are kept by Cloudflare for short periods under its own policy.

Your rights

Wherever you live, you can ask me to:

• tell you whether I hold your information and give you a copy (access);
• correct or update it (rectification);
• delete it (cancellation or deletion);
• stop using it for emails or other purposes (opposition, withdrawal of consent).

Send your request to Emey@expatproperties.com. It's free. I may ask you to confirm it's really you, usually by replying from the same email address. I will respond within the time your local law requires, listed below.

I protect your information with reasonable safeguards, including encrypted connections (HTTPS) and limited access to the subscriber list. No system is perfect; if a breach affects you, I will tell you and the relevant authority where the law requires it.

Costa Rica

Under Law 8968, Protection of the Person regarding the Processing of Personal Data, you give your informed, express consent when you submit a form, and you can withdraw it at any time. At collection you are told: that a database exists, its purposes, who receives the data, which answers are required, the consequences of not providing them, your rights, and who is responsible and where (see Who I am). Requests for access, rectification or deletion are answered free of charge within five business days. You may complain to the Agencia de Protección de Datos de los Habitantes (PRODHAB).

Canada

For visitors in Canada, I follow the fair information principles of the Personal Information Protection and Electronic Documents Act (PIPEDA): I collect only what is needed for the purposes above, with your consent, and I am accountable for it. I respond to access requests within 30 days. Commercial emails follow Canada's Anti-Spam Legislation (CASL): express opt-in consent, sender identification and a working unsubscribe link. You can complain to the Office of the Privacy Commissioner of Canada.

California

This policy is posted as required by the California Online Privacy Protection Act (CalOPPA). In the last 12 months, the categories of personal information collected are identifiers (name, email address, IP address) and internet activity on this site (pages requested), from you directly and from your browser, for the purposes listed above. I do not sell or share personal information and do not use sensitive personal information. California residents may request access, correction or deletion as described in Your rights, and will not be treated differently for doing so. You can use an authorized agent if you give them written permission. I answer within 45 days.

Changes to this policy

If I change this policy, I will update the date at the top. For significant changes affecting how your data is used, I will also notify subscribers by email before the change takes effect.
